Everyday Rewards Sweepstakes - Terms & Conditions of Entry

The Everyday Rewards Sweepstakes (the "Promotion") is a promotion conducted under the Extra Rewards component of the Everyday Rewards Program.
  1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if any entries do not comply with these Terms & Conditions of Entry.

  2. The Promotion is open to all Woolworths or Safeway customers who shop at a Participating Supermarket and have Registered for the Everyday Rewards Program at everydayrewards.com.au (the "Website"), by telephoning the Customer Service Centre on 1300 10 1234 (the "Call Centre"), or by completing and returning the Everyday Rewards Registration Form to the address specified on the Registration Form. Entry into the Promotion is free. Directors, management and employees of Direct Headquarters Pty Ltd and its agencies directly associated with this Promotion are ineligible to enter.

    These Terms & Conditions of Entry will be displayed in store at each Participating Supermarket at the commencement of the Promotion and will also be available on the Website or by telephoning the Call Centre.

  3. Definitions within this Promotion:
    Card means an Everyday Rewards Card issued by the Promoter as part of the Everyday Rewards Program.

    Cardholder
    means a person who holds an Everyday Rewards Card, and who is Registered according to the Everyday Rewards Program database.

    Participating Supermarket
    means a Woolworths or Safeway Supermarket promoting the Everyday Rewards program, located within Queensland, Western Australia, South Australia, the Northern Territory, the Australian Capital Territory, Victoria or New South Wales, plus Homeshop, found at homeshop.com.au

    Promotion
    means the Everyday Rewards Sweepstakes promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the Extra Rewards component of the Everyday Rewards Program.

    Promotional Period
    means 1/09/2008 to 4/01/2009.

    Registered
    means that all mandatory Cardholder information has been correctly completed in the legal name of the Cardholder, according to the Everyday Rewards database.

  4. Entries for the prize draws close each Sunday (Saturday in the case of non-Sunday trading stores) during the Promotional Period, at midnight AEST.

  5. To enter the Promotion, a Cardholder must present and swipe their Card before paying for their purchases at a Participating Supermarket (or purchase via homeshop). One entry will be recorded for each purchase transaction; however, for each Participating Supermarket a maximum of one entry per Card will be recorded for any transactions within a single calendar day. In Queensland and South Australia, "Smoking / Tobacco" product purchases are excluded from entry, by law.

  6. Breaking a single transaction into multiple amounts for use with one or more Cards is not permitted, and will void all Promotion entries attributable to such Cardholders.

  7. Prize winners will be determined by an automated random draw of all valid entries. Prize draws will take place at 12 noon EST on each Wednesday of the following week, the first draw being 10/09/08 and last being 07/01/09. The prize draws will take place at Direct Headquarters Pty Ltd, Level 2, 7 Kelly Street, Ultimo, NSW.

  8. The first valid entries randomly drawn for each state will be the winners. All prize winners will be contacted by email and/or mail, and published on the Website. Winners will also be announced in The Australian in the following lots: Winners for w/c 01/09/2008 to 28/09/2008 will be published on the 08/10/2008, Winners for w/c 29/09/2008 to 02/11/2008 will be published on the 12/11/2008, Winners for w/c 03/11/2008 to 30/11/2008 will be published on the 10/12/2008, Winners for w/c 01/12/2008 to 04/01/2009 will be published on the 14/01/2009. If a winning entry is invalid, that entry will be discarded and the prize will be awarded by randomly drawing another entry in accordance with these Terms & Conditions of Entry.

  9. Each week during the Promotional Period, eleven (11) state winners will be drawn, three (3) from each of the following regions: NSW/ACT (including Homeshop), QLD, VIC and one (1) from each of WA and SA/NT. There will be a total of 198 (one hundred and ninety eight) State prizes of $1,000 worth of WISH Gift Cards. WISH Gift Cards are valid for 12 months – see wishgiftcard.com.au for full terms and conditions of use. The Total Prize pool value is $198,000, available to Cardholders shopping at Participating Supermarkets in respective regions as follows: ACT $54,000; QLD $54,000; NSW $54,000; SA $18,000; NT $18,000; VIC $54,000; WA $18,000.

  10. Prizes are not transferable or exchangeable and cannot be redeemed for cash.

  11. If a winner does not claim their prize within 3 months from the date of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary on 06/04/2009 at 12:15pm in order to distribute any prizes unclaimed by that date. Any such winners will be contacted by email and/or mail, and have their names published on the Website and in the Public Notices section of the Australian on the 13/04/2009.

  12. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.

  13. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of the Terms & Conditions of Entry or the Terms and Conditions of the Everyday Rewards Program or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

  14. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

  15. The Promoter may use any personal information that a Cardholder has provided to it as part of the Everyday Rewards Program for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner's surname, initial and Participating Supermarket location. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Unless the Cardholder has opted-out of communication within their Registration, the Promoter may use personal information a Cardholder has provided to send the Cardholder information about Woolworths' products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies and contractors (including call centers, advertising agencies and direct mail houses) the Promoter engages for that purpose. The Promoter is bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of the Promoter's privacy policy can be viewed at the Website. To request access to, or to update, personal information the Promoter holds about them, entrants can contact the Promoter in writing at Everyday Rewards, PO Box 8000, Baulkham Hills NSW 2153.

  16. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
